Anti-Harassment Training and CoachingEmployment law today is rapidly becoming diversity law. While sexual harassment cases have decreased nationwide, hostile work environment claims on the basis of age, race, religion, national origin, disability and sexual orientation are increasing dramatically. Even among sexual harassment cases there has been a noticeable increase in the diversity of plaintiffs – more women of color for example are filing clams. So too are men and gay, lesbian, bisexual and transgendered employees.

In response to rising hostile work environment claims, the courts have taken two actions of vital concern to employers. First, they have dramatically increased employer liability for employment-based harassment – particularly where it was caused by managers and supervisors. Second, they have created a new affirmative defense against harassment claims which is predicated, in part, on the effectiveness of corporate training initiatives.

As a result, there are two clear implications for employers:

  1. The Courts and State Legislatures Are Rapidly Creating “The Law of Training” – Insisting That Employers Provide Training That Works.
  1. A Growing Body of Law Holds That Employers Can Be Held Legally Liable for The Training Event Itself – Including the Conduct of Corporate or External Trainers.
